Dear Senator Hatch (& about 4th cousin),
 
I have written Senator Frist a reply which I paste in below regarding this same subject.  We shall all stand before God, and that is the stand that I want to take honorably.  Unfortuneately, the Republican Party principles have stood together with a President who probably after he leaves office should be taken to the Hague to be tried for crimes against humanity.
 
Your letter is well written, and does raise fears at to what we can expect after November's election.  But their are certain principles that require support by taking a stand for them.  One is habeas corpus...which with the consent and/or connivance of the "stand together" policy of Republican leaders supporting Bush...has been denied to our fellow humans, endowed with rights by God, and vouchsafed in the Constitution (principles to be "forever" http://www.degaston.org/government/OurAmerConsti.doc).   We can be grateful that this principle has been upheld after all of these years by the Supreme Court, though to be it is a sad commentary on the state of matters that it was a split 5 to 4 decision.
 
Joseph Smith spent months in Liberty Jail because of being denied habeas corpus, and finally escaped.  J. Smith complained to the Lord of this incarceration, and the 121st Section of the D&C contains the Lord's answer. But you as a Republican leader are responsible for supporting worse by Bush than imposed upon J. Smith by the local Sheriff upon thousands over far more than a few months.  Has not the Republican Party as a whole exercised unrighteous dominion in exercising its authority in government?
 
You, Senator, have not raised a strong voice (if any) against kidnapping ("extraordinary rendition"...who dreamed up this phrase for a felony?) carried out not only on our soil but in other nations abroad, mayhem (torture, waterboarding, etc.), and murder (felony murder and evidence for more than felony murder exists).
 
Now, I don't like the Democrats' programs as a whole, but are more taxes (or the fear of such despite denials by Obama and Clinton) a lesser evil than torturing men, and some to death?  I cannot stand with the Republican Party as a whole at this time, nor generally support the Democrats.  I am glad that there are other alternatives.

Dear Senator Frist,
 
With lachrymose regrets I must reply that I cannot support the Republican Party per se because the Republican Party as a whole has turned back the clock of human progress against tyranny.  The Republican Party is the principal instrument in undermining our Constitution, the basis of the "laws" that have given us liberty per the quote from Santander.
 
The Republican Party (for which I worked for years, even serving as President of the Orange Republican Assembly in California) has sold to a gullible and divided public a "waterboarding" president, kidnapping (extradinordinary rendition), mayhem by the Executive Branch (torture is mayhem), and murder by our government...all to protect us from "terrorism".
 
Terrorism may cost us lives, but so has the fight for freedom and liberties over the years.  So for the lives that may be lost to terrorists, why should we support the Patriot Act (a real twist and what should be an oxymorphism), defeat of habeas corpus, etc., and thus lose what we have (had)?
 
Benjamin Franklin penned in 1759,   "They that can give up essential liberty to obtain a little temporary safety deserve neither liberty nor safety."
 
True leadership would teach the public to be courageous in the face of terrorism, and to use all abilities short of giving up their essential liberties (& Constitutional guarantees of same)...and yes, FAITH IN GOD, as supplication would be made to Him that he would succor us in our time of need as he did our COURAGEOUS Founding Fathers and their spiritual progeny through the years...until power has gone to our heads through the "leadership" of the present Republican Party.

Civil Rights, and how the Supreme Law is being broken by those who took the oath:
The Oath Requirement for all civil officers (for even the policeman as it says all;
The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution;  Article VI

The Supreme Law is being broken by subverting/betraying the following Constitutionally guaranteed rights :

Some of the fundamental changes to Americans' legal rights by the Bush administration and the USA Patriot Act following the terror attacks, "911" (Associated Press, September 5, 2002):

* FREEDOM OF ASSOCIATION:
Government may monitor religious and political institutions without suspecting criminal activity to assist terror investigation.

* FREEDOM OF INFORMATION:
Government has closed once-public immigration hearings, has secretly detained hundreds of people without charges, and has encouraged bureaucrats to resist public records requests.

* FREEDOM OF SPEECH:
Government may prosecute librarians or keepers of any other records if they tell anyone that the government subpoenaed information related to a terror investigation.

* RIGHT TO LEGAL REPRESENTATION:
Government may monitor federal prison jailhouse conversations between attorneys and clients, and deny lawyers to Americans accused of crimes.

* FREEDOM FROM UNREASONABLE SEARCHES:
Government may search and seize Americans' papers and effects without probable cause to assist terror investigation.

* RIGHT TO A SPEEDY AND PUBLIC TRIAL:
Government may jail Americans indefinitely without a trial.

* RIGHT TO LIBERTY:
Americans may be jailed without being charged or being able to confront witnesses against them.



The USA Patriot Act is not lawful or legal even though passed by Congress and signed by the pushy President Bush because only the people can change the Constitution (and hence the "law"), and that by the provisions within the Constitution:

   ``It is manifest that it was not left to the legislative power to enact any process which might be devised. The article [5th Amendment, ed. by Dad] is a restraint on the legislative as well as on the executive and judicial powers of the government, and cannot be so construed as to leave congress free to make any process `due process of law' by its mere will.''  Murray's Lessee v. Hoboken Land and Improvement Co. 59 U.S. (18 How.) 272, 276 (1856).

My strong thoughts and poignant feelings about what we Americans are letting our "leaders" do is expressed by a founding father thus:

 WE HAVE TURNED CHICKEN! 
 That is we are throwing away our freedoms to save our necks...hardly patriotic, and we call it

National Republican Senatorial Committee

For all of us, there comes a time when the choices are so stark, the risks so great, we have to take a stand.  We can no longer assume someone else will save us.  We have to step forward and be counted. 

We face such a time today.  If we don't take a stand against the coming Democratic tsunami, the country we know and love today will be lost.

I believe the Democrats when they say they plan to double our taxes.  I believe them when they guarantee they will rewrite federal labor law so unions can reorganize the workforce without a secret ballot election.  I believe them when they promise the trial bar they will strip away what few rights companies still have.  I believe them when they say they are going to appoint liberal judges to the Supreme Court and swamp our federal benches all over the land.  I believe them and so should you!

When the next President is sworn in, 6 of the 9 Supreme Court Justices will be over 70 years old. This could mean the next President could seat a new majority to the court.

And, I believe them when they vow to spend close to $100 million dollars to elect a super majority in the Senate, a majority so big that the Senate will no longer be our nation's legislative firewall.

Just this week, the Senator in charge of raising money to get Democratic Senators elected said they are going to pickup nine seats in the US Senate. Nine seats! Do you know what that would mean! That would mean they could pass every piece of their liberal agenda through the House and the Senate untouched! There would not be a tax they could not raise or a freedom they could not abridge.

And you know, there is nothing they won't say, nothing they won't do to win. Presidential hopeful Barak Obama has already raised millions to win the Presidency and he has now decided to raise funds for Democrats in the House. Just last week he wrote a letter to Democrats around the country asking them to pour money into the House Democrat money machine.

All we Republicans can count on is ourselves.  We either stand together, we either support our Senate candidates, or we are lost.

I am doing all I can to ensure the Democrats don't have a super-majority. You need to do all you can to help.

Ask yourself - what is it worth to keep what I earn?  $25, $50, 75?

What is freedom worth?  $100, $250, $500, $1,000?

What is my country worth?

Join me. Help our Republican Senate candidates withstand the coming storm. Help keep America free.  Take a stand.  Don't let Barak Obama and Chuck Schumer decide what this country is going to look like.  Make a contribution, and together, let's save our country.

Can I count on you?
